By accessing or using NextMachina ("the Service"), available at nextmachina.ai, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Service.

The Service is operated by Peter Lipcak, an individual ("we", "us", "our").

Description of Service

NextMachina is an AI-powered personal development application. It provides AI-driven conversational support for self-reflection, personal growth, and building better habits.

Important: NextMachina is not a medical service or substitute for professional advice of any kind. The Service is an AI tool for personal development and does not provide clinical, diagnostic, or emergency support. If you are in crisis or having thoughts of self-harm, please contact a crisis helpline or emergency services immediately.

The AI-generated responses are created by artificial intelligence and may be inaccurate, incomplete, or unsuitable for your specific situation. You are solely responsible for how you interpret and act upon any information provided by the Service. We make no claims regarding specific outcomes or benefits.

Account Requirements

You must be at least 16 years old to use the Service. By creating an account, you confirm that you meet this age requirement. You are responsible for maintaining the security of your account and password. Each account is intended for individual use only and must not be shared with others.

Your Content

You retain ownership of any content you create or submit through the Service. By using the Service, you grant us a limited license to host, store, and process your content solely for the purpose of providing and improving the Service.

Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Harass, abuse, or harm others through the Service
  • Attempt to interfere with or disrupt the Service
  • Reverse engineer, decompile, or disassemble any part of the Service

Payments and Subscriptions

NextMachina offers free and paid subscription plans. Payments are processed securely by our payment provider, Paddle (Paddle.com Market Limited). When you purchase a subscription:

  • You agree to pay all fees associated with your selected plan
  • Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled before the renewal date
  • Prices are inclusive of applicable taxes, which are calculated and collected by Paddle based on your location
  • We will provide at least 30 days advance notice before any price changes take effect

By completing a purchase, you also agree to Paddle's Terms of Use and Privacy Policy.

Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • You will retain access to paid features until the end of your current billing period
  • Your subscription will not renew after the current period ends
  • No partial refunds are provided for unused time within a billing period

Refund Policy

All payments are generally non-refundable. However, refunds may be issued if you are charged in error due to a technical issue or if required by applicable consumer protection laws in your jurisdiction.

To request a refund, contact us at support@nextmachina.ai. Refund requests are handled on a case-by-case basis. Paddle, as our payment provider, processes all refunds.

Service Availability

We strive to keep the Service available at all times, but we do not guarantee uninterrupted, timely, or error-free operation. We may modify, suspend, or discontinue the Service (or any part of it) at any time with reasonable notice where possible.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We disclaim all implied warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

Without limiting the foregoing, we make no warranty that:

  • The Service will meet your specific requirements or expectations
  • AI-generated responses will be accurate, reliable, complete, or appropriate for your situation
  • The Service will be suitable for addressing any particular personal concern or situation
  • The results obtained from using the Service will be beneficial to your well-being

Assumption of Risk

By using the Service, you acknowledge and agree that:

  • You use the Service at your own risk and discretion
  • You are solely responsible for any decisions or actions you take based on information provided by the Service
  • The Service is not designed for use in emergency or crisis situations
  • You will seek qualified professional help for any serious personal or medical concerns
  • AI responses may contain errors, biases, or inappropriate suggestions, and should not be relied upon as professional advice

Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the Service. This includes, without limitation, any damages arising from:

  • Reliance on AI-generated content or advice
  • Decisions made based on interactions with the Service
  • Any harm related to the use of the Service
  • Failure to seek appropriate professional help

Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

Changes to Terms

We may update these Terms from time to time. We will provide at least 30 days advance notice of material changes. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of Spain. Any disputes arising from these Terms shall be resolved exclusively in the courts of Spain.
